Inspire! Privacy and Security LLC (“Inspire!,” “we,” “our,” and “us”) is a limited liability company located in Mapleton, Utah, USA. Inspire! provides business consulting services via this website via books and other on-line forums (“Inspire! Platform”). Our goal is to create a single source of truth for privacy, data protection, and artificial intelligence compliance professionals. Come and join us!

Please read these Terms of Service (“Terms”) carefully. They contain the legal terms and conditions that govern your (“you” or “your”) use of the Inspire! Platform, including information, text, images, graphics, data, or other materials (“Content”). By using the Inspire! Platform, you agree to be bound by these Terms, including in your capacity as a visitor to the Inspire! Platform.

1. Registration

You must register to access the Inspire! Platform. During the registration process we will ask you to verify your identity before you gain access to the Inspire! Platform. You must agree that the information you provide to us upon registration, at the time of purchase, and at all other times is true, accurate, and current to complete your registration. You also agree that you will ensure your registration information will be maintained by you as accurate and always kept up to date. This is especially important with respect to your email address, since that is the primary way we will communicate with you about your account. You agree that your account is personal and will only be used by you, and that you will not share the registration identification you receive upon approval (“User ID”). You must immediately notify us of any unauthorized use of your Inspire! Platform User ID.

To register on the Inspire! Platform, you must be 13 years old or lawfully permitted to enter and form contracts under applicable law. If at any time we discover that you’ve registered with inaccurate information we will revoke your registration and terminate your account.

2. Password

When you register on the Inspire! Platform you will be asked to provide a password. You are responsible for safeguarding the password and you agree not to disclose your password to anyone. You agree you are solely responsible for any activities or actions that occur because of the use of your password, whether you have authorized the activities or actions or not. You must immediately notify us of any unauthorized use of your password.

3. Availability

The Inspire! Platform is provided on an “AS IS” and “AS Available” basis and Inspire! reserves the right to modify, suspend, or discontinue the Inspire! Platform, in its sole discretion, at any time and without notice. You agree that Inspire! Privacy and Security LLC is not and will not be liable to you for any modification, suspension, or discontinuance that may occur on the Inspire! Platform.

4. Privacy

Inspire! Privacy and Security LLC knows your personal information is important. We appreciate the trust you place in us when you visit and use the Inspire! Platform. As a result, we process the personal information we receive from you responsibly and in accordance with applicable laws and regulations as described in our Privacy Notice, which is incorporated into and forms part of these Terms.

5. Monitoring Content

Inspire! Privacy and Security LLC has no ability to control how you use the Inspire! Platform and we do not have any obligation to monitor your use for any purpose. You acknowledge that you are solely responsible for your use of the Inspire! Platform. However, if we become aware of any illegal, fraudulent, or unethical activities on the Inspire! Platform, we will act accordingly which may include removal of any infringing Content or Content associated with unethical behavior.

6. Storage Policy

Content associated with registered accounts for the Inspire! Platform are stored with the third-party cloud storage providers listed on the third-party sub-processor list located on the Inspire! Platform. By using the Inspire! Platform, you acknowledge and agree that Inspire! Privacy and Security LLC may use the third-party cloud providers listed on the Inspire! Platform, and at its option, establishing storage limits concerning your account, including without limitation the maximum number of days the Content associated with your account will be retained, the maximum size of any associated Content files that may be stored on the Inspire! Platform, the maximum disk space that will be allotted to you for the storage of Content on Inspire! Privacy and Security LLC’s servers. If you do not agree to the third-party sub-processors listed on the Inspire! Platform, your only remedy is to terminate use of the Inspire! Platform.

You acknowledge that Inspire! Privacy and Security LL has reserved the right to terminate or suspend accounts that are inactive, in Inspire! Privacy and Security LLC’s sole discretion, for an extended period (thus deleting or suspending access to the Content associated with your account). Inspire! Privacy and Security LLC has no responsibility or liability for the deletion or failure to store any Content maintained on the Inspire! Platform. You further acknowledge and agree that Inspire! Privacy and Security LLC reserves the right to modify its storage policies from time to time, with or without notice to you.

7. General Conduct

You agree that you will not interfere with or disrupt (or attempt to interfere with or disrupt) the Inspire! Platform or its associated servers or networks, or disobey any requirements, procedures, policies or regulations of networks connected to the Inspire! Platform; or provide any information to Inspire! that is false or misleading, that attempts to hide your identity or that you do not have the right to disclose. Inspire! Privacy and Security LLC does not endorse any content placed on the Inspire! Platform by third-parties or any opinions or advice contained in the third-party content. You agree and understand that use of multiple accounts is prohibited. You agree to defend, indemnify, and hold Inspire! Privacy and Security LLC harmless, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and expert fees, arising out of or in any way connected with your access to or use of the Inspire! Platform, or your violation of these Terms.

8. Etiquette Policy

You agree to be subject to and to conduct yourself in accordance with the following Inspire! etiquette rules (“Etiquette Policy”) when using the Inspire! Platform, you must use not use the Inspire! Platform:

1. For any unlawful purposes;
2. To upload, post, or otherwise transmit any material that is obscene, offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, an invasion of privacy or publicity rights, defamatory, libelous, vulgar, illegal, or otherwise objectionable;
3. To upload, post, or otherwise transmit any material that infringes any copyright, trademark, patent, or other intellectual property right or any moral right or artist’s right of any third party including, but not limited to, Inspire! Privacy and Security LLC or to facilitate the unlawful distribution of copyrighted content or illegal content;
4. To harm minors in any way, including, but not limited to, uploading, posting, or otherwise transmitting content that violates child pornography laws, child sexual exploitation laws or laws prohibiting the depiction of minors engaged in sexual conduct, or submitting any personally identifiable information about any child under the age of 13;
5. To forge headers or otherwise manipulate identifiers to disguise the origin of any Content transmitted through the Inspire! Platform;
6. To upload, post, or otherwise transmit any material which is likely to cause harm to Inspire! Privacy and Security LLC or anyone else’s computer systems, including but not limited to that which contains any virus, code, worm, data or other files or programs designed to damage or allow unauthorized access to the Inspire! Platform which may cause any defect, error, malfunction, or corruption to the Inspire! Platform;
7. For any commercial purpose, except as expressly permitted under these Terms;
8. To sell access to the Inspire! Platform on any other website or to use the Inspire! Platform on another website for the primary purpose of gaining advertising or subscription revenue other than a personal blog or social network where the primary purpose is to display content from Inspire! Privacy and Security LLC by hyperlink and not to compete with Inspire! Privacy and Security LLC.

9. Trademarks

All brand, product and Inspire! Platform names used on the Inspire! Platform which identifies Inspire! Privacy and Security LLC, or any third parties and their products and the Inspire! Platform are proprietary marks of Inspire! Privacy and Security LLC and/or the relevant third parties. Nothing in these Terms or the Inspire! Platform confers on any natural person or entity a license or right with respect to any image, logo, or name.

10. Copyright

Inspire! Privacy and Security LLC is, unless otherwise stated, the owner of all copyright and data rights on the Inspire! Platform, including any user generated Content (“UGC”) that may be created by you on the Inspire! Platform. Any UGC created by you must not be subject to any other copyright or licensed from another copyright owner or his or her agent any other type of copyright encumbrance and must not contain Confidential Information as defined in the Inspire! Privacy and Security Global Privacy Notice. You may not reproduce, distribute, publicly display, or perform, or prepare derivative works based on any of the Content, including any UGC without the express, written consent of Inspire!.

11. Reporting Copyright Violations

Inspire! Privacy and Security LLC respects the intellectual property rights of others and expects users of the Inspire! Platform to do the same. At our discretion and in appropriate circumstances, we may remove any Content (including UGC) from the Inspire! Platform, terminate accounts, or prevent access to the Inspire! Platform if there is an actual or suspected infringement of the intellectual property rights of others.

If you believe the copyright in your work has been infringed, on the Inspire! Platform you must file a copyright infringement notification with us (also commonly known as a “DMCA takedown notice”) at: info@privacyandsecurity.com, the copyright owner or an authorized agent acting on his or her behalf as a written communication that includes substantially the following:

1. A physical or electronic signature of the copyright owner or of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Inspire! Platform provider to locate the material. In this regard, please provide URLs when you identify the location of the material.
4. Information reasonably sufficient to permit the Inspire! Platform provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Inspire! Privacy and Security LLC may provide links to third-party websites or resources via the Inspire! Platform. You acknowledge and agree that Inspire! is not responsible or liable for: (i) the availability or accuracy of any third-party links, or resource(s), or (ii) the third-party links, or resources themselves. Any provision of third-party links or resources do not imply any endorsement by Inspire! Privacy and Security LLC. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party links, or resources provided to you via the Inspire! Platform, and that the associated third-party terms of service and privacy notice will apply to your use.

13. Payment

The Inspire! Platform offers two different types of accounts: (i) Free, and a (ii) Paid Subscription.

Free Accounts – All visitors to the Inspire! Platform will have the opportunity to register and set up a “free” account. This account provides limited access to limited Content on the Inspire! Platform. Access to Inspire! Platform Content will only be provided after your identity has been verified. All Terms apply to use of the Inspire! Platform via your free account.

Paid Subscription Accounts – Upon initiating the registration process for the Inspire! Platform, you will receive an opportunity to set up a paid subscription account. This type of account will require you to provide your payment information via a third-party payment platform, which is listed on the sub-processor list located on the Inspire! Platform. You can cancel your paid subscription account at any time, which will not expire until the end of its term. There are no fees or costs associated with cancelling your paid subscription account. You can remove your payment information in accordance with the third-party payment platform terms of service and privacy notice. Unless otherwise stated, all Inspire! Privacy and Security LLC subscriptions are recurring. That means your paid subscription account will renew before 365 days have passed from the date your registration was accepted, unless you tell us you do not want your paid subscription account to renew. You must terminate your paid subscription account no later than 30 days before the renewal date to avoid its renewal.

Inspire! Privacy and Security LLC paid accounts are non-refundable. They are considered “used at the point of purchase.”
However, we are a small team, and we care deeply about our community. If there are genuine extenuating circumstances in your case, please contact us, and we will do our best to help you out. Refunds incur significant charges to us in transaction fees and handling charges. Inspire! Privacy and Security LLC is obliged by law to provide refunds for purchases only if your purchase has been made illegally.

14. Suspension and Termination of Access Rights

You agree that Inspire! Privacy and Security LLC may at any time, and without notice, suspend or terminate any part of the Inspire! Platform, or refuse to fulfill any order, or any part of any order or terminate your account and delete any Content stored by Inspire! Privacy and Security LLC, in Inspire! Privacy and Security LLC’s sole discretion, if you fail to comply with the Terms or applicable law.

15. Disclaimer of Warranty and Limitation of Liability

INSPIRE! PRIVACY AND SECURITY LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED AS TO THE OPERATION OF THE INSPIRE! PLATFORM, OR THE CONTENT OR PRODUCTS, PROVIDED THROUGH THE INSPIRE! PLATFORM. YOU EXPRESSLY AGREE THAT YOUR USE OF THE INSPIRE! PLATFORM IS AT YOUR SOLE RISK. INSPIRE! PRIVACY AND SECURITY LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. INSPIRE! PRIVACY AND SECURITY LLC MAKES NO WARRANTY AS TO THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THIS INSPIRE! PLATFORM YOU SPECIFICALLY ACKNOWLEDGE THAT INSPIRE! PRIVACY AND SECURITY LLC IS NOT LIABLE FOR YOUR DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT, OR SUCH CONDUCT BY THIRD PARTIES, AND YOU EXPRESSLY ASSUME ALL RISKS AND RESPONSIBILITY FOR DAMAGES AND LOSSES ARISING FROM SUCH CONDUCT. EXCEPT FOR THE EXPRESS, LIMITED REMEDIES PROVIDED HEREIN, AND TO THE FULLEST EXTENT ALLOWED BY LAW, INSPIRE! PRIVACY AND SECURITY LLC SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM USE OF THE INSPIRE! PLATFORM, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, EVEN IF INSPIRE! PRIVACY AND SECURITY LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING DISCLAIMERS, WAIVERS AND LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF OR LIMITATIONS ON CERTAIN WARRANTIES OR DAMAGES. THEREFORE, SOME OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL INSPIRE! PRIVACY AND SECURITY LLC AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNTS PAID BY YOU TO INSPIRE! PRIVACY AND SECURITY LLC PURSUANT TO THESE TERMS.

16. Amendments

Inspire! Privacy and Security LLC reserves the right to amend these Terms from time to time in our sole discretion. If you have registered on the Inspire! Platform, we will notify you of any material changes to these Terms (and the effective date of the changes) by sending an email to the address you have provided to Inspire! Privacy and Security LLC for your account. For all other users, we will post the revised terms on the Inspire! Platform. If you continue to use the Inspire! Platform after the effective date of the revised Terms, you will be deemed to have accepted those changes. If you do not agree to the revised Terms, your sole remedy is to discontinue using the Inspire! Platform.

17. General

These Terms constitute the entire agreement between Inspire! Privacy and Security LLC and you with respect to your use of the Inspire! Platform. Inspire! Privacy and Security LLC’s failure to enforce any right or provision in these Terms does not constitute a waiver of any right or provision. If a court should find that one or more provisions contained in these Terms is invalid, you agree that the remainder of the Terms are enforceable. Inspire! Privacy and Security LLC has the right to assign its rights and/or delegate its obligations under these Terms, in whole or in part, to any person or business entity. You may not assign your rights or delegate your obligations under these Terms without the prior written consent of Inspire! Privacy and Security LLC. These Terms are governed by and construed in accordance with the laws of the State of Utah. Any disputes arising under or in connection with these Terms are subject to the exclusive jurisdiction of the state and federal courts of the State of Utah.
